                                     AN ACT

     1  Amending Title 44 (Law and Justice) of the Pennsylvania
     2     Consolidated Statutes, establishing a registry of certain
     3     drug offenders; and providing for duties of the Pennsylvania
     4     State Police.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 44 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a chapter to read:
     9                             CHAPTER 25
    10                       DRUG OFFENDER REGISTRY
    11  Sec.
    12  2501.  Definitions.
    13  2502.  Registry established.
    14  2503.  Contents of registry.
    15  2504.  Reporting.
    16  2505.  Availability.


     1  2506.  Removal.
     2  § 2501.  Definitions.
     3     The following words and phrases when used in this chapter
     4  shall have the meanings given to them in this section unless the
     5  context clearly indicates otherwise:
     6     "Convicted."  Includes having pleaded guilty or nolo
     7  contendere.
     8     "Registry."  The Drug Offender Registry established in
     9  section 2502 (relating to registry established).
    10  § 2502.  Registry established.
    11     The Pennsylvania State Police shall establish a Drug Offender
    12  Registry of persons convicted after the effective date of this
    13  section of a violation of section 13(a)(14), (30) or (37) of the
    14  act of April 14, 1972 (P.L.233, No.64), known as The Controlled
    15  Substance, Drug, Device and Cosmetic Act, where the controlled
    16  substance is methamphetamine or is a salt, isomer or salt of an
    17  isomer of methamphetamine or is a mixture containing
    18  methamphetamine, containing a salt of methamphetamine,
    19  containing an isomer of methamphetamine or containing a salt of
    20  an isomer of methamphetamine.
    21  § 2503.  Contents of registry.
    22     The registry shall consist of the following information:
    23         (1)  The person's name.
    24         (2)  The person's date of birth.
    25         (3)  The offense or offenses making the person eligible
    26     for inclusion on the registry.
    27         (4)  The conviction date of the person and the county
    28     where the conviction occurred.
    29         (5)  Other identifying data as the Pennsylvania State
    30     Police determines is necessary to properly identify the

     1     person, not including the person's Social Security number.
     2  § 2504.  Reporting.
     3     Beginning July 1, 2007, the office of clerk of the court of
     4  common pleas shall transmit to the Pennsylvania State Police,
     5  within 45 days after final judgment of conviction, a record of
     6  the conviction and date of birth of all persons who are
     7  convicted of the offenses described in section 2502 (relating to
     8  registry established).
     9  § 2505.  Availability.
    10     The Pennsylvania State Police shall make registry information
    11  available for public inquiry on the Internet.
    12  § 2506.  Removal.
    13     The Pennsylvania State Police shall remove from the registry
    14  the name and other identifying information of a person who is
    15  convicted of an offense described in section 2502 (relating to
    16  registry established) seven years after the date of the most
    17  recent conviction.
    18     Section 2.  This act shall take effect in 60 days.
