           BARLEY, TRELLO, HERSHEY, NAHILL, BUNT, MERRY, TIGUE, CLYMER,
           GIGLIOTTI, VEON, JOHNSON, HOWLETT, BURD, OLIVER, BELARDI,
           LINTON, DeLUCA, OLASZ, HALUSKA, SERAFINI, ACOSTA AND HECKLER,

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           APRIL 4, 1989

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for restoration of operating
     3     privileges.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1545 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1545.  Restoration of operating privilege.
     9     Upon the restoration of any person's operating privilege
    10  which has been suspended [or revoked pursuant to this             <--
    11  subchapter,] under section 1539 (relating to suspension of        <--
    12  operating privilege on accumulation of points), such person's
    13  record shall show five points, except that any additional points
    14  [assessed against the person] assigned to the person's record     <--
    15  since the date of the last violation resulting in the suspension
    16  [or revocation] shall be added to such five points unless the     <--

     1  person has served an additional period of suspension [or          <--
     2  revocation] pursuant to section 1544(a) (relating to additional   <--
     3  period of revocation or suspension). This section shall not
     4  apply to [section 1533 (relating to suspension of operating       <--
     5  privilege for failure to respond to citation)] , 7102(B)          <--
     6  (RELATING TO REMOVAL OR FALSIFICATION OF IDENTIFICATION NUMBER),
     7  7103(B) (RELATING TO DEALING IN VEHICLES WITH REMOVED OR
     8  FALSIFIED NUMBERS), 7111 (RELATING TO DEALING IN TITLES AND
     9  PLATES FOR STOLEN VEHICLES), 7121 (RELATING TO FALSE APPLICATION
    10  FOR CERTIFICATE OF TITLE OR REGISTRATION) OR 7122 (RELATING TO
    11  ALTERED, FORGED OR COUNTERFEIT DOCUMENTS AND PLATES) OR TO 18
    12  Pa.C.S. § 6310.4 (relating to restriction of operating
    13  privileges).
    14     Section 2.  This act insofar as it relates to 18 Pa.C.S. §
    15  6310.4 (relating to restriction of operating privileges) shall
    16  be retroactive to May 24, 1988.
    17     Section 3.  This act shall take effect in 60 days.
