                                     AN ACT

     1  Requiring insurers that approve claims for emergency services to
     2     directly reimburse organizations that provide such services.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Emergency
     7  Service Organization Direct Reimbursement Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Emergency service organization."  An ambulance service,
    13  emergency medical service or river rescue service that is
    14  located in this Commonwealth.
    15     "Insurer."  An insurance company, association or exchange or


     1  any other entity subject to the jurisdiction of the Insurance
     2  Department.
     3  Section 3.  Direct reimbursement to emergency service
     4                 organizations.
     5     An insurer that approves a claim that includes the expense
     6  charged by an emergency service organization shall make payment
     7  of the claim that represents such expense directly to the
     8  emergency service organization, unless the person who filed the
     9  claim demonstrates to the insurer that he or someone on his
    10  behalf already paid such expense.
    11  Section 10.  Effective date.
    12     This act shall take effect in 60 days.
