                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for revocation of habitual
     3     offender's license and for certain restrictions on trucks
     4     registered in Class 10 or higher.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1542(b) of Title 75 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 1542.  Revocation of habitual offender's license.
    10     * * *
    11     (b)  Offenses enumerated.--Three convictions arising from
    12  separate and distinct acts of any one or more of the following
    13  offenses committed [either] singularly [or in combination] by
    14  any person shall result in such person being designated as a
    15  habitual offender:
    16         (1)  Any offense set forth in section 1532 (relating to
    17     revocation or suspension of operating privilege).


     1         (2)  Operation following suspension of registration as
     2     defined in section 1371 (relating to operation following
     3     suspension of registration).
     4         (3)  Making use of or operating any vehicle without the
     5     knowledge or consent of the owner or custodian thereof.
     6         (4)  Utilizing a vehicle in the unlawful transportation
     7     or unlawful sale of alcohol or any controlled substance.
     8         (5)  Any felony in the commission of which a court
     9     determines that a vehicle was essentially involved.

    11     Section 2.  Section 3311 of Title 75 is amended by adding a
    12  subsection to read:
    13  § 3311.  Driving on divided highway.
    14     * * *
    15     (c)  Truck limitation.--It shall be unlawful for any truck,
    16  truck tractor or combination registered in Class 10 or higher to
    17  operate in the extreme left lane of any divided highway unless
    18  it is passing a slower moving vehicle located in the right lane.
    19  Any truck, truck tractor or combination shall not operate in the
    20  extreme left lane of a divided highway for a distance of greater
    21  than one mile while passing other vehicles.
    22     Section 3.  This act shall take effect in 60 days.
