                                     AN ACT

     1  Amending Title 74 (Transportation) of the Pennsylvania
     2     Consolidated Statutes, designating a portion of State Route 6
     3     in Wyoming County as a scenic byway.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 74 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 8305.  Designation of State Route 6 as scenic byway.
     9     (a)  General rule.--Because designation of the three miles
    10  between the interchange with Business Route 6 on the west side
    11  of Tunkhannock Borough to the Business Route 6 interchange in
    12  Tunkhannock Township on the east side of the borough will
    13  preserve magnificent views and will educate residents and future
    14  residents of the importance of promoting the cultural and


     1  archeological area around Tunkhannock Borough, State Route 6 in
     2  Wyoming County from the interchange with Business Route 6 on the
     3  west side of Tunkhannock Borough to the Business Route 6
     4  interchange in Tunkhannock Township on the east side of the
     5  borough is designated as a scenic byway.
     6     (b)  Effect of designation.--No outdoor advertising device,
     7  as defined in section 3 of the act of December 15, 1971
     8  (P.L.596, No.160), known as the Outdoor Advertising Control Act
     9  of 1971, may be erected:
    10         (1)  within 660 feet of the nearest edge of the right-of-
    11     way; or
    12         (2)  more than 660 feet from the nearest edge of the
    13     right-of-way, outside of urban areas, if the sign is visible
    14     from the main-traveled way of the scenic byway and the
    15     purpose of the sign is that its message be read from the
    16     main-traveled way of the scenic byway, except:
    17             (i)  the official signs and notices which are
    18         required or authorized by law and which conform to the
    19         national standards promulgated by the Secretary of
    20         Transportation of the United States pursuant to 23 U.S.C.
    21         § 131 (relating to control of outdoor advertising);
    22             (ii)  outdoor advertising devices advertising the
    23         sale or lease of the real property upon which they are
    24         located;
    25             (iii)  outdoor advertising devices advertising
    26         activities conducted on the property on which they are
    27         located, including devices which display a message that
    28         may be changed at reasonable intervals by electronic
    29         process or remote control;
    30             (iv)  directional signs, including, but not limited

     1         to, signs pertaining to natural wonders, scenic and
     2         historical attractions and other points of interest to
     3         the traveling public which conform to the national
     4         standards promulgated by the Secretary of Transportation
     5         of the United States pursuant to 23 U.S.C. § 131; and
     6             (v)  signs approved by the department designating the
     7         route as a scenic byway installed in accordance with
     8         department requirements.
     9     Section 2.  This act shall take effect in 60 days.
