HOUSE RESOLUTION

No. 209 Session of 1999


        INTRODUCED BY METCALFE, ROHRER, DAILEY, BARRAR, STEVENSON,
           HERSHEY, FORCIER, LEH, BASTIAN, CAWLEY, EGOLF, FAIRCHILD,
           FICHTER, KENNEY, LYNCH, PESCI, E. Z. TAYLOR, ORIE, SAYLOR,
           TIGUE, WOGAN, YOUNGBLOOD, PIPPY, HABAY AND BENNINGHOFF,
           JUNE 14, 1999

        REFERRED TO COMMITTEE ON RULES, JUNE 14, 1999

                                  A RESOLUTION

     1  Instructing the Education Committee to conduct a comprehensive
     2     review of the Public School Code of 1949 and regulations of
     3     the State Board of Education in order to identify regulations
     4     inconsistent with that act.

     5     WHEREAS, The Public School Code of 1949 is the primary
     6  statutory basis for the public school system in this
     7  Commonwealth; and
     8     WHEREAS, The State Board of Education has promulgated a
     9  myriad of regulations based upon the Public School Code of 1949;
    10  and
    11     WHEREAS, Some of those regulations are believed to be
    12  inconsistent with the Public School Code of 1949; and
    13     WHEREAS, Regulations that are inconsistent with statutory law
    14  are void and of no effect; and
    15     WHEREAS, Inconsistent regulations of the State Board of
    16  Education need to be identified; and
    17     WHEREAS, Identifying these inconsistent regulations will


     1  serve as a first step toward scrutinizing the matter of
     2  unnecessary, unfunded and underfunded State mandates imposed on
     3  school districts by regulation; therefore be it
     4     RESOLVED, That the Education Committee conduct a thorough,
     5  comprehensive review of the Public School Code of 1949 and
     6  regulations of the State Board of Education in order to identify
     7  regulations inconsistent with that act; and be it further
     8     RESOLVED, That the Education Committee shall report to the
     9  House of Representatives on its findings and recommendations by
    10  November 16, 2000.
