        REFERRED TO COMMITTEE ON RULES, DECEMBER 6, 1989

                                  A RESOLUTION

     1  Directing the Secretary of Public Welfare to make changes in
     2     regulations to permit Medical Assistance nursing home
     3     patients to retain lottery rent rebates.

     4     WHEREAS, Department of Public Welfare regulations promulgated
     5  in November of 1988 changed the income provisions under the
     6  Medical Assistance program; and
     7     WHEREAS, Those changes have had the unintended result of
     8  forcing nursing home residents to give up the rent rebate
     9  benefits received from the State lottery to offset the
    10  Department of Public Welfare's payment for nursing home care;
    11  and
    12     WHEREAS, Medical Assistance nursing home patients relied on
    13  receiving this money to help them meet their personal needs; and
    14     WHEREAS, For many Medical Assistance nursing home patients,
    15  their rent rebate was the only way they could maintain their


     1  dignity and self-respect; therefore be it
     2     RESOLVED, That the General Assembly request that the
     3  Secretary of Public Welfare change the regulations to categorize
     4  rent rebates as items that are not income under 55 Pa. Code §
     5  181.81 (relating to items that are not income) to exclude the
     6  rent rebate moneys from consideration when patient cost of care
     7  for nursing home residents is calculated; and be it further
     8     RESOLVED, That a copy of this resolution be transmitted to
     9  John F. White, Jr., Secretary of Public Welfare of the
    10  Commonwealth.
