AN ACT

 

1Amending the act of July 2, 1993 (P.L.345, No.48), entitled "An
2act empowering the General Counsel or his designee to issue
3subpoenas for certain licensing board activities; providing
4for hearing examiners in the Bureau of Professional and
5Occupational Affairs; providing additional powers to the
6Commissioner of Professional and Occupational Affairs; and
7further providing for civil penalties and license
8suspension," further providing for hearing examiners.

9The General Assembly of the Commonwealth of Pennsylvania
10hereby enacts as follows:

11Section 1.  Section 3 of the act of July 2, 1993 (P.L.345,
12No.48), entitled "An act empowering the General Counsel or his
13designee to issue subpoenas for certain licensing board
14activities; providing for hearing examiners in the Bureau of
15Professional and Occupational Affairs; providing additional
16powers to the Commissioner of Professional and Occupational
17Affairs; and further providing for civil penalties and license
18suspension," is amended by adding a subsection to read:

19Section 3.  Hearing examiners.

1(e)  Reporting of offenses.--Each holder of a license,
2registration, certificate or permit from a licensing board or
3commission shall report to the issuing licensing board or
4commission, in writing, within 30 days, if the individual has
5been convicted, found guilty or pleaded nolo contendere, or
6received probation without verdict or received accelerated
7rehabilitative disposition as to any felony or misdemeanor or
8any drug violation. A criminal matter that has been expunged by
9order of a court is not required to be reported.

10Section 2.  This act shall take effect in 60 days.
