           T. STEVENSON, FAIRCHILD, YOUNGBLOOD, HARPER, SOLOBAY, TRUE,
           SATHER, ROSS, E. Z. TAYLOR, ZUG, CRAHALLA, SAYLOR, CAPPELLI,

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MAY 2, 2005

                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," further providing for specific powers.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1502 of the act of June 24, 1931
     8  (P.L.1206, No.331), known as The First Class Township Code,
     9  reenacted and amended May 27, 1949 (P.L.1955, No.569), is
    10  amended by adding a clause to read:
    11     Section 1502.  The corporate power of a township of the first
    12  class shall be vested in the board of township commissioners.
    13  The board shall have power--

    15     LXXVIII.  Appropriations to Watershed Associations. To
    16  appropriate money to nonprofit watershed associations for

     1  watersheds serving the township. ANY MONEYS APPROPRIATED TO A     <--
     2  NONPROFIT WATERSHED ASSOCIATION BY THE TOWNSHIP SHALL BE USED
     3  ONLY FOR THE FOLLOWING PURPOSES: WETLAND RESTORATION; STREAM
     4  BANK STABILIZATION; RIPARIAN BUFFER RESTORATION; WATERWAY
     5  CLEANUP INVOLVING REMOVAL OF TRASH OR OTHER MANMADE DEBRIS
     6  WITHIN THE WATERWAY; IMPROVEMENTS TO ELIMINATE ACID MINE
     7  DRAINAGE IMPACTS; AND FOR EXPENSES DIRECTLY RELATED TO
     8  ADMINISTRATION AND OPERATION, INCLUDING, BUT NOT LIMITED TO,
     9  RENT AND OFFICE ITEMS. SUCH APPROPRIATIONS MAY NOT BE USED TO
    10  UNDERTAKE LITIGATION AGAINST ANY MUNICIPAL CORPORATION OR TO
    11  SEEK REDRESS AGAINST ANY INDIVIDUAL LANDOWNER.
    12     Section 2.  This act shall take effect in 60 days.
