                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for period of revocation or
     3     suspension of operating privilege.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1541(a) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1541.  Period of revocation or suspension of operating
     9             privilege.
    10     (a)  Commencement of period.--
    11         (1)  The period of disqualification, revocation or
    12     suspension of the operating privilege or the disqualification
    13     of the commercial operating privilege shall commence as
    14     provided for in section 1540 (relating to surrender of
    15     license).
    16         (2)  No credit toward the revocation, suspension or

     1     disqualification shall be earned until the driver's license
     2     is surrendered to the department, the court or the district
     3     attorney, as the case may be. A nonresident licensed driver
     4     or an unlicensed driver, including a driver whose license has
     5     expired, shall submit an acknowledgment of suspension or
     6     revocation to the department in lieu of a driver's license,
     7     except for the suspension of the operating privilege of an
     8     unlicensed driver under 16 years of age, in which case the
     9     suspension shall commence automatically upon the individual's
    10     16th birthday for the specified period if an acknowledgment
    11     is received any time prior to the individual's 16th birthday.
    12     If a licensed driver is not in possession of his driver's
    13     license, no credit toward the disqualification, revocation or
    14     suspension shall be earned until a sworn affidavit or a form
    15     prescribed by the department is surrendered to the department
    16     swearing that the driver is not in possession of his driver's
    17     license. Such credit shall be rescinded if it is later
    18     determined that the driver was untruthful in the affidavit.
    19         (3)  Credit shall also be revoked if a person surrenders
    20     a duplicate license and it is later determined that the
    21     person was still in possession of an earlier issued,
    22     unexpired license.
    23         (4)  Credit shall also be revoked for any time period in
    24     which the person whose license is suspended, revoked or
    25     disqualified is incarcerated for a violation of this title.
    26         (5)  The department may, upon request of the person whose
    27     license is suspended or disqualified, delay the commencement
    28     of the period of suspension or disqualification for a period
    29     not exceeding six months whenever the department determines
    30     that failure to grant the extension will result in hardship

     1     to the person whose license has been suspended or
     2     disqualified.
