HOUSE RESOLUTION

No. 302 Session of 2005


        INTRODUCED BY DeLUCA, BARRAR, CALTAGIRONE, FREEMAN, GABIG,
           GOODMAN, HERSHEY, JAMES, JOSEPHS, O'NEILL, ROBERTS, STABACK,
           WALKO, WHEATLEY AND YOUNGBLOOD, MAY 10, 2005

        REFERRED TO COMMITTEE ON JUDICIARY, MAY 10, 2005

                                  A RESOLUTION

     1  Directing the Joint State Government Commission to study
     2     mandatory sentencing for offenses committed with firearms.

     3     WHEREAS, Mandatory minimum five-year sentencing is imposed
     4  under the Judicial Code for offenses committed with firearms;
     5  and
     6     WHEREAS, The House of Representatives should know about the
     7  procedure and effect of this sentencing enhancement; therefore
     8  be it
     9     RESOLVED, That the Joint State Government Commission make a
    10  study of the implementation of 42 Pa.C.S. § 9712 (relating to
    11  sentences for offenses committed with firearms); and be it
    12  further
    13     RESOLVED, That the study include number of cases, type of
    14  cases and whether the sentencing is concurrent or consecutive;
    15  and be it further
    16     RESOLVED, That the study compare statistics on offenses
    17  committed with firearms before and after the implementation of


     1  the mandatory minimum sentencing enhancement; and be it further
     2     RESOLVED, That the commission report its findings and
     3  recommendations to the House of Representatives as soon as
     4  possible.
