                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for restitution for
     3     injuries to person or property.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The definitions of "restitution" and "victim" in
     7  section 1106(h) of Title 18 of the Pennsylvania Consolidated
     8  Statutes are amended and the section is amended by adding a
     9  definition to read:
    10  § 1106.  Restitution for injuries to person or property.

    12     (h)  Definitions.--As used in this section, the following
    13  words and phrases shall have the meanings given to them in this
    14  subsection:

    16     "Law enforcement officer."  An individual who has been
    17  trained in accordance with 53 Pa.C.S. Ch. 21 Subch. D (relating

     1  to municipal police education and training) or a member of the
     2  Pennsylvania State Police.

     4     "Restitution."  The return of the property of [the] a victim
     5  or payments in cash or the equivalent thereof pursuant to an
     6  order of the court. The term also includes cash as reimbursement
     7  to an employing government for out-of-pocket medical expenses
     8  incurred and workers' compensation benefits paid to a law
     9  enforcement officer directly resulting from the investigation,
    10  arrest, or both, of an offender, provided that the offender is
    11  ultimately convicted.
    12     "Victim."  As defined in section 479.1 of the act of April 9,
    13  1929 (P.L.177, No.175), known as The Administrative Code of
    14  1929. The term includes the Crime Victim's Compensation Fund if
    15  compensation has been paid by the Crime Victim's Compensation
    16  Fund to the victim and any insurance company that has
    17  compensated the victim for loss under an insurance contract. The
    18  term also includes a law enforcement officer who suffers
    19  personal injury directly resulting from the investigation,
    20  arrest, or both, of an offender, provided that the offender is
    21  ultimately convicted.
    22     Section 2.  This act shall take effect in 60 days.
