                                     AN ACT

     1  Providing for annual, unannounced inspections of personal care
     2     homes; and making a related repeal.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Annual
     7  Unannounced Inspection of Personal Care Homes Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of Public Welfare of the
    13  Commonwealth.
    14     "Personal care home."  As defined in section 1001 of the act
    15  of June 13, 1967 (P.L.31, No.21), known as the Public Welfare

     1  Code.
     2  Section 3.  Annual, unannounced inspection.
     3     A personal care home shall be subject to requirements set
     4  forth in section 211 and Articles IX and X of the act of June
     5  13, 1967 (P.L.31, No.21), known as the Public Welfare Code, and
     6  regulations adopted pursuant thereto, except that the annual on-
     7  site inspection shall be unannounced.
     8  Section 9.  Repeal.
     9     (a)  Intent.--The General Assembly declares that the repeal
    10  under subsection (b) is necessary to effectuate this act.
    11     (b)  Provision.--Section 211(l) of the act of June 13, 1967
    12  (P.L.31, No.21), known as the Public Welfare Code, is repealed.
    13  Section 10.  Effective date.
    14     This act shall take effect immediately.
