                                     AN ACT

     1  Amending Title 25 (Elections) of the Pennsylvania Consolidated
     2     Statutes, further providing for sources to obtain information
     3     on the death of a registrant.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1505 of Title 25 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1505.  Death of registrant.
     9     (a)  Department of Health.--A commission shall cancel the
    10  registration of a registered elector reported dead by the
    11  Department of Health. The Department of Health shall, within 60
    12  days of receiving notice of the death of an individual 18 years


     1  of age or older, send the name and address of residence of that
     2  individual to a commission in a manner and on a form prescribed
     3  by the department. The commission shall promptly update
     4  information contained in its registration records.
     5     (b)  Other sources.--A commission may also utilize published
     6  newspaper obituaries, letters testamentary [or], letters of
     7  administration issued by the office of the registrar of wills or
     8  documentation received by the commission pursuant to subsection
     9  (b.1) to cancel and remove the registration of an elector,
    10  provided that such removals are uniform, nondiscriminatory and
    11  in compliance with the Voting Rights Act of 1965 (Public Law 89-
    12  110, 42 U.S.C. § 1973 et seq.). The commission shall promptly
    13  update information contained in its registration records.
    14     (b.1)  Notification by funeral directors.--The department
    15  shall prepare and distribute to each commission a form to be
    16  used by funeral homes to report the names of deceased
    17  individuals to the commission. The form shall include the name
    18  of the funeral home and the name of the funeral director and
    19  shall allow for the listing of the name, date of birth, date of
    20  death and address of each deceased individual. The commission
    21  shall distribute copies of the form to each funeral home located
    22  in the applicable county and shall encourage each funeral home
    23  to report the names of deceased individuals to the commission on
    24  a periodic basis, as determined by the commission, but not more
    25  often than monthly. A commission may accept completed forms
    26  submitted by facsimile.
    27     (c)  Corrections.--An individual incorrectly reported
    28  deceased by the Department of Health or incorrectly removed by a
    29  commission for reason of death may appear in person before a
    30  commissioner, registrar or clerk at the office of the commission

     1  and prove identity. The commission, upon such proof, shall
     2  correct its registration records.
     3     Section 2.  This act shall take effect in 90 days.
