AN ACT 1 Amending Titles 18 (Crimes and Offenses) and 23 (Domestic 2 Relations) of the Pennsylvania Consolidated Statutes, further 3 providing for general regulations relating to criminal 4 history record information and for information relating to 5 prospective child-care personnel. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 9121(b) of Title 18 of the Pennsylvania 9 Consolidated Statutes is amended to read: 10 § 9121. General regulations. 11 * * * 12 (b) Dissemination to noncriminal justice agencies and 13 individuals.--Criminal history record information shall be 14 disseminated by a State or local police department to any
1 individual or noncriminal justice agency only upon request. 2 Except as provided in subsection (b.1): 3 (1) A fee may be charged by a State or local police 4 department for each request for criminal history record 5 information by an individual or noncriminal justice agency, 6 except that no fee shall be charged to an individual who 7 makes the request in order to [apply to become a volunteer 8 with an affiliate of Big Brothers of America or Big Sisters 9 of America.] volunteer with an affiliate of any group which 10 primarily works with children, including, but not limited to, 11 the Boy Scouts of America, Big Sisters of America, Big 12 Brothers of America, a religious-related group or 13 organization, A SPORTS PROGRAM AS DEFINED IN 42 PA.C.S. § <-- 14 8332.1 (RELATING TO MANAGER, COACH, UMPIRE OR REFEREE AND 15 NONPROFIT ASSOCIATION NEGLIGENCE STANDARD), YMCA, YWCA, 4-H 16 Club or a block parent program, including, but not limited 17 to, the McGruff House Program. 18 (2) Before a State or local police department 19 disseminates criminal history record information to an 20 individual or noncriminal justice agency, it shall extract 21 from the record all notations of arrests, indictments or 22 other information relating to the initiation of criminal 23 proceedings where: 24 (i) three years have elapsed from the date of 25 arrest; 26 (ii) no conviction has occurred; and 27 (iii) no proceedings are pending seeking a 28 conviction. 29 * * * 30 Section 2.
