AN ACT 1 Amending the act of April 12, 1951 (P.L.90, No.21), entitled, as 2 reenacted, "An act relating to alcoholic liquors, alcohol and 3 malt and brewed beverages; amending, revising, consolidating 4 and changing the laws relating thereto; regulating and 5 restricting the manufacture, purchase, sale, possession, 6 consumption, importation, transportation, furnishing, holding 7 in bond, holding in storage, traffic in and use of alcoholic 8 liquors, alcohol and malt and brewed beverages and the 9 persons engaged or employed therein; defining the powers and 10 duties of the Pennsylvania Liquor Control Board; providing 11 for the establishment and operation of State liquor stores, 12 for the payment of certain license fees to the respective 13 municipalities and townships, for the abatement of certain 14 nuisances and, in certain cases, for search and seizure 15 without warrant; prescribing penalties and forfeitures; 16 providing for local option, and repealing existing laws," 17 further providing for revocation and suspension of licenses 18 and for sales by licensees. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 Section 1. Section 406(a) of the act of April 12, 1951 22 (P.L.90, No.21), known as the Liquor Code, reenacted and amended 23 June 29, 1987 (P.L.32, No.14), is amended by adding a paragraph 24 to read: 25 Section 406. Sales by Liquor Licensees; Restrictions.--(a)
1 * * * 2 (7) Notwithstanding any provision of this act, on the Sunday 3 on which the sporting event commonly referred to as the "Super 4 Bowl" is conducted, licensees who do not possess the special 5 annual permit provided for in paragraph (3), their servants, 6 agents or employes may sell liquor and malt or brewed beverages 7 on such Sunday after one o'clock postmeridian and until two 8 o'clock antemeridian of the following day. 9 * * * 10 Section 2. Section 471(a) of the act is amended to read: 11 Section 471. Revocation and Suspension of Licenses; Fines.-- 12 (a) Upon learning of any violation of this act or any laws of 13 this Commonwealth relating to liquor, alcohol or malt or brewed 14 beverages, or of any regulations of the board adopted pursuant 15 to such laws, or any violation of any laws of this Commonwealth 16 or of the Federal Government relating to the payment of taxes on 17 liquor, alcohol or malt or brewed beverages by any licensee 18 within the scope of this article, his officers, servants, agents 19 or employes, or upon any other sufficient cause shown, the 20 enforcement bureau may, within one year from the date of such 21 violation or cause appearing, cite such licensee to appear 22 before an administrative law judge, [not less than ten nor more 23 than sixty days from the date of sending such licensee,] by 24 sending by registered mail, a notice addressed to him at his 25 licensed premises, to show cause why such license should not be 26 suspended or revoked or a fine imposed, or both. The bureau 27 shall also send a copy of the hearing notice to the municipality 28 in which the premises is located. A decision on the citation 29 shall be rendered by the administrative law judge within one 30 hundred eighty days of the issuance of the citation, except for 19970H0346B0390 - 2 -
