AN ACT
1 Authorizing the incurring of indebtedness, with the approval of
2 the electors, of $100,000,000 to provide additional funding
3 for the purchase of agricultural conservation easements for
4 the preservation of agricultural land; and making a repeal.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Referendum.
8 The question of incurring indebtedness of $100,000,000 to
9 provide additional funding for the purchase of agricultural
10 conservation easements for the preservation of agricultural land
11 shall be submitted to the electors at the next primary,
12 municipal or general election following the effective date of
13 this act.
14 Section 2. Certification.
15 The Secretary of the Commonwealth shall forthwith certify the
16 question to the county boards of election.
17 Section 3. Form of question.
18 The question shall be in substantially the following form:
1 Do you favor the incurring of indebtedness by the
2 Commonwealth of $100,000,000 to provide additional
3 funding for the purchase of agricultural conservation
4 easements for the preservation of agricultural land
5 either for a period of 25 years or in perpetuity? <--
6 Section 4. Conduct of referendum.
7 The election shall be conducted in accordance with the act of
8 June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania
9 Election Code, except that the time limits for advertisement of
10 notice of the election may be waived as to the question.
11 Section 5. Use of bond proceeds.
12 Proceeds of borrowing shall be used to provide additional
13 funding to purchase agricultural conservation easements to
14 promote the planned preservation of agricultural land throughout
15 this Commonwealth under the act of June 30, 1981 (P.L.128,
16 No.43), known as the Agricultural Area Security Law.
17 Section 6. Repeal.
18 Section 14.3(f) of the act of June 30, 1981 (P.L.128, No.43),
19 known as the Agricultural Area Security Law, is repealed.
20 Section 7. Effective date.
21 This act shall take effect immediately.
