AN ACT
1 Prohibiting the issuance of certain permits.
2 The General Assembly of the Commonwealth of Pennsylvania
3 hereby enacts as follows:
4 Section 1. Definitions.
5 The following words and phrases when used in this act shall
6 have the meanings given to them in this section unless the
7 context clearly indicates otherwise:
8 "Department." The Department of Environmental Protection of
9 the Commonwealth.
10 "Freeway." The term shall have the meaning given to it under
11 75 Pa.C.S. § 102 (relating to definitions).
12 "Municipal waste." The term shall have the meaning given to
13 it under the act of July 7, 1980 (P.L.380, No.97), known as the
14 Solid Waste Management Act.
15 "Municipal waste disposal facility." A landfill or an
16 incinerator used or capable of being used for the disposal of
17 municipal waste.
1 Section 2. Issuance of permits.
2 Notwithstanding any other provision of law, the department
3 shall not issue a permit under the act of July 7, 1980 (P.L.380,
4 No.97), known as the Solid Waste Management Act, for the
5 construction of a new, or the expansion of an existing,
6 municipal waste disposal facility that is located more than ten
7 miles from a freeway interchange ramp.
8 Section 3. Effective date.
9 This act shall take effect immediately.
