                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for criminal
     3     mischief.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3304(b) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3304.  Criminal mischief.
     9     * * *
    10     (b)  Grading.--Criminal mischief is a felony of the second
    11  degree if the actor intentionally causes pecuniary loss in
    12  excess of $5,000, or a substantial interruption or impairment of
    13  public communication, CELLULAR OR WIRELESS COMMUNICATION,         <--
    14  transportation, supply of water, gas or power, or other public
    15  service. It is a misdemeanor of the second degree if the actor


     1  intentionally causes pecuniary loss in excess of $1,000, or a
     2  misdemeanor of the third degree if he intentionally or
     3  recklessly causes pecuniary loss in excess of $500 or causes a
     4  loss in excess of $150 for a violation of subsection (a)(4).
     5  Otherwise criminal mischief is a summary offense.
     6     Section 2.  The amendment of 18 Pa.C.S. § 3304(b) shall apply
     7  to offenses committed on or after the effective date of this
     8  act.
     9     Section 3.  This act shall take effect in 60 days.
