HOUSE BILL

No. 379 Session of 1989

                                     AN ACT

     1  Authorizing the incurring of indebtedness, with the approval of
     2     the electors, for the permanent improvement of Pennsylvania's
     3     streams and creeks by removing stream blockage flooding
     4     hazards affecting the health and safety of persons and
     5     properties in this Commonwealth created by surface runoff and
     6     for providing physical protection from such hazards.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9  Section 1.  Incurring indebtedness.
    10     The question of incurring indebtedness of $20,000,000 for the
    11  removal of stream blockage flooding hazards created by surface
    12  runoff of solid materials from adjacent drainage areas into this
    13  Commonwealth's streams and creeks and to provide physical
    14  safeguards against such hazards shall be submitted to the
    15  electors at the next primary, municipal or general election
    16  following enactment of this act.
    17  Section 2.  Certification of question.
    18     The Secretary of the Commonwealth shall forthwith certify the
    19  question to the county boards of election.
    20  Section 3.  Question to electorate.

     1     The question shall be in substantially the following form:
     2         Do you favor the incurring of indebtedness by the
     3         Commonwealth of $20,000,000 for stream and creek
     4         improvements, removal of stream and creek blockage and
     5         installation of physical safeguards against flooding
     6         hazards resulting from surface runoff?
     7  Section 4.  Conduct of election.
     8     The election shall be conducted in accordance with the act of
     9  June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania
    10  Election Code, except that the time limits for advertisement of
    11  notice of the election may be waived as to the question.
    12  Section 5.  Use of proceeds.
    13     The proceeds of borrowing shall be used in the manner
    14  determined by the General Assembly for the removal of stream
    15  blockage flooding hazards created by surface runoff of solid
    16  materials from adjacent areas into this Commonwealth's streams
    17  and creeks and to permanently provide, as practical, against
    18  such blockage.
    19  Section 6.  Effective date.
    20     This act shall take effect immediately.
