                                     AN ACT

     1  Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An
     2     act providing for safe drinking water; imposing powers and
     3     duties on the Department of Environmental Resources in
     4     relation thereto; and appropriating certain funds," providing
     5     for notice to ratepayers of construction, repair or
     6     maintenance work on water systems.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of May 1, 1984 (P.L.206, No.43), known as
    10  the Pennsylvania Safe Drinking Water Act, is amended by adding a
    11  section to read:
    12  Section 11.1.  Notice of construction, repair or maintenance.
    13     (a)  Requirement.--The permittee of a public water system
    14  shall give reasonable notice to all ratepayers of construction,
    15  repair or maintenance work being performed on the water system.
    16     (b)  Reimbursement for damages.--A permittee shall reimburse
    17  ratepayers for damage to furnaces, appliances and other property
    18  by failure to provide adequate notice of such construction,
    19  repair or maintenance as provided in subsection (a).
    20     (c)  Exception.--This section does not apply to emergency

     1  repairs which are commenced immediately upon knowledge of a
     2  system breakdown and which are completed or reliably estimated
     3  to be completed within 24 hours of the occurrence of the
     4  breakdown.
     5     (d)  Notification procedure.--Notification under this section
     6  shall be given not less than 24 hours prior to the commencement
     7  of the construction, repair or maintenance work in a manner
     8  prescribed in section 11(b) through (e).
     9     Section 2.  This act shall take effect in 60 days.
