                                     AN ACT

     1  Amending the act of June 30, 1981 (P.L.128, No.43), entitled "An
     2     act authorizing the creation of agricultural areas," further
     3     providing for purchase of agricultural conservation
     4     easements.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 14.1 of the act of June 30, 1981
     8  (P.L.128, No.43), known as the Agricultural Area Security Law,
     9  is amended by adding a subsection to read:
    10  Section 14.1.  Purchase of agricultural conservation easements.

    12     (l)  Purchases from certain charitable trusts.--Nothing in
    13  this section shall prohibit the State board or the county board
    14  from purchasing an agricultural easement held in a pooled income
    15  fund, charitable remainder annuity trust or charitable remainder

     1  unitrust, as defined in sections 642(c)(5) and 664 of the
     2  Internal Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. §§
     3  642(c)(5) and 664). The State board and county board shall apply
     4  the same standards, criteria, procedures, limitations and
     5  requirements to evaluate and purchase agricultural conservation
     6  easements held in a pooled income fund, charitable remainder
     7  annuity trust or charitable remainder unitrust as are applicable
     8  under this section for evaluation and purchase of agricultural
     9  conservation easements generally.
    10     Section 2.  This act shall take effect immediately.
