                                     AN ACT

     1  Amending Title 23 (Domestic Relations) of the Pennsylvania
     2     Consolidated Statutes, further providing for alimony pendente
     3     lite, counsel fees and expenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3702 of Title 23 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3702.  Alimony pendente lite, counsel fees and expenses.
     9     (a)  General rule.--In proper cases, upon petition, the court
    10  may allow a spouse reasonable alimony pendente lite, spousal
    11  support and reasonable counsel fees and expenses. Reasonable
    12  counsel fees and expenses may be allowed pendente lite, and the
    13  court shall also have authority to direct that adequate health
    14  and hospitalization insurance coverage be maintained for the
    15  dependent spouse pendente lite.
    16     (b)  Effect of remarriage.--An obligation to pay alimony
    17  pendente lite shall cease upon the remarriage of the party
    18  receiving alimony pendente lite, provided, however, that any

     1  amount of alimony pendente lite in arrears at the time the
     2  obligation ceases shall remain due and payable in accordance
     3  with the prior court order or an order entered pursuant to
     4  section 3703 (relating to enforcement of arrearages).
     5     Section 2.  This act shall take effect in 60 days.
