AN ACT 1 Requiring criminal history record and child abuse record 2 information for certain persons who reside in family day-care 3 homes. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Criminal and child abuse history information. 7 In addition to the requirements of 23 Pa.C.S. § 6344 8 (relating to information relating to prospective child-care 9 personnel), an individual who applies to the Department of 10 Public Welfare for a registration certificate to operate a 11 family day-care home shall include criminal history record and 12 child abuse record information required under section 6344(b) 13 for every individual 18 years of age or older who resides in the 14 home for at least 30 days in a calendar year. 15 Section 2. Required information. 16 Child abuse record information required under section 1 shall
1 include certification by the Department of Public Welfare as to 2 whether the applicant is named in the central register as the 3 perpetrator of a founded report of child abuse, indicated report 4 of child abuse, founded report for school employee or indicated 5 report for school employee as defined in 23 Pa.C.S. § 6303 6 (relating to definitions). 7 Section 3. Effect on registration. 8 The department shall refuse to issue or renew a registration 9 certificate or shall revoke a registration certificate if the 10 family day-care home provider or individual 18 years of age or 11 older who has resided in the home for at least 30 days in a 12 calendar year: 13 (1) is named in the central register on child abuse 14 established under 23 Pa.C.S. Ch. 63 (relating to child 15 protective services) as the perpetrator of a founded report 16 of child abuse committed within the immediately preceding 17 five-year period; or 18 (2) has been convicted of an offense enumerated in 23 19 Pa.C.S. § 6344(c). 20 Section 4. Regulations. 21 The Department of Public Welfare shall promulgate regulations 22 to administer this act. 23 Section 5. Effective date. 24 This act shall take effect in 60 days.
