                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing for liability
     4     insurance for family day care homes; and further providing
     5     for records in family day care homes.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     9  as the Public Welfare Code, is amended by adding a section to
    10  read:
    11     Section 1072.1.  Liability Insurance.--In order to continue
    12  operation, a family day care home must have a comprehensive
    13  general liability insurance policy to cover all persons on the
    14  premises in a minimum amount to be determined by regulation of
    15  the department.
    16     Section 2.  Section 1075 of the act, added December 5, 1980
    17  (P.L.1112, No.193), is amended to read:

     1     Section 1075.  Records.--Every individual who operates a
     2  family day care home registered under this article shall keep
     3  and maintain such records as required by the department. A copy
     4  of the insurance policy under section 1072.1 shall be kept on
     5  the premises.
     6     Section 3.  The Department of Public Welfare shall promulgate
     7  regulations to administer section 1072.1 of the act.
     8     Section 4.  This act shall take effect as follows:
     9         (1)  The following provisions shall take effect on the
    10     effective date of regulations promulgated under section 3.
    11             (i)  The addition of section 1072.1 of the act.
    12             (ii)  The amendment of section 1075 of the act.
    13         (2)  The remainder of this act shall take effect
    14     immediately.
