A RESOLUTION
Directing the Pennsylvania Department of Health to integrate
Application Programming Interface (API) technology as
required under section 701(c.1) of the act of April 17, 2016
(P.L.84, No.16), known as the Medical Marijuana Act, to
enhance data interoperability and streamline data
communication within the Medical Marijuana Program and ensure
that all relevant measures are taken to achieve the intended
goals of the act.
WHEREAS, On June 30, 2021, Governor Wolf signed House Bill
1024 into law as Act 44 of 2021; and
WHEREAS, Act 44 contained sustainable updates to the act of
April 17, 2016 (P.L.84, No.16), known as the Medical Marijuana
Act, including the use of Application Programming Interface
(API) for enhanced interoperability and data communication
between the Department of Health's current seed-to-sale vendor
and medical marijuana organizations; and
WHEREAS, The Department of Health was tasked with the
implementation of Act 44, including the full integration of API;
and
WHEREAS, As of the writing of this resolution, seven approved
vendors do not have access to two-way API despite the

requirements of Act 44; and
WHEREAS, Medical marijuana organizations and related
entities, including approved testing laboratories, must manually
enter sales and testing data in the absence of API; and
WHEREAS, The current seed-to-sale vendor has been
experiencing chronic outages that have required dispensaries to
turn away patients and products to be destroyed; and
WHEREAS, If API was fully integrated, dispensaries could
remain open and serve customers; therefore be it
RESOLVED, That the House of Representatives direct the
Department of Health to integrate API technology as required
under section 701(c.1) of the act of April 17, 2016 (P.L.84,
No.16), known as the Medical Marijuana Act, to enhance data
interoperability and streamline data communication within the
Medical Marijuana Program and ensure that all relevant measures
are taken to achieve the intended goals of the act; and be it
further
RESOLVED, That the House of Representatives direct the
Department of Health to prepare a written review of the contract
with the department's current seed-to-sale tracking vendor,
which the department shall submit to the House of
Representatives within 30 days.
