                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for eligibility for
     3     paralyzed veteran's pension.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7702 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 7702.  Paralyzed veteran's pension.
     9     (a)  Amount and eligibility.--In addition to any other
    10  assistance provided by the Commonwealth and in addition to any
    11  compensation provided by the Federal Government, every paralyzed
    12  veteran shall be paid a pension of $150 per month. Applications
    13  for the pensions shall be made to and in the form prescribed by

     1  the department. The Adjutant General shall determine the
     2  eligibility of every applicant for a pension, and his decision
     3  in the matter shall be final.
     4     (b)  Regulations.--The Adjutant General shall promulgate such
     5  regulations as may be necessary to implement this program.
     6     (c)  Definition.--As used in this section the term "paralyzed
     7  veteran" means any person who served in the military or naval
     8  forces of the United States, or any woman's organization
     9  officially connected therewith, [during an established war or
    10  armed conflict service dates,] and who gave this Commonwealth as
    11  his or her place of residence at the time of entering the
    12  military or naval forces of the United States [and is currently
    13  a resident of this Commonwealth] and who, while performing
    14  duties connected with [that] such service, suffered an injury or
    15  incurred a disease which resulted in the loss or loss of use of
    16  two or more extremities. The term does not include any person
    17  separated from the military or naval forces of the United
    18  States, or any woman's organization officially connected
    19  therewith, under other than honorable conditions. [The term
    20  shall include persons who have been paralyzed as a result of
    21  peacetime combat-related actions as defined by the Department of
    22  Military Affairs. The department shall, by regulation, establish
    23  criteria to determine eligibility based on participation in a
    24  peacetime combat-related situation, which shall include, but not
    25  be limited to, hostile fire or terrorist attack.]
    26     Section 2.  This act shall take effect July 1, 2001.
