        INTRODUCED AS NONCONTROVERSIAL RESOLUTION UNDER RULE 35,
           JUNE 4, 1998

                                  A RESOLUTION

     1  Memorializing the President and Congress of the United States to
     2     revise the requirement that applicants for hunting and
     3     fishing licenses provide their Social Security numbers.

     4     WHEREAS, Section 5536 of the Balanced Budget Act of 1997,
     5  Public Law 105-33, amended Federal law to require each state to
     6  have in place laws requiring applicants for recreational
     7  licenses (hunting and fishing) to provide their Social Security
     8  numbers; and
     9     WHEREAS, The Commonwealth of Pennsylvania has implemented
    10  this Federal mandate through the amendatory act of December 16,
    11  1997 (P.L.549, No.58), to Title 23; and
    12     WHEREAS, The Commonwealth of Pennsylvania strongly supports
    13  all effective mechanisms to encourage payment of child support
    14  obligations; and

     1     WHEREAS, Requiring applicants for hunting and fishing
     2  licenses to provide their Social Security numbers does not
     3  appear to enhance effective enforcement of child support
     4  obligations inasmuch as hunting and fishing license records are
     5  not retrievable by reference to the Social Security numbers; and
     6     WHEREAS, The vast majority of hunting and fishing licenses
     7  are not sold by government agencies but are sold by private
     8  businesses ranging in size from large department stores to small
     9  bait and outdoor shops; and
    10     WHEREAS, Imposing the requirement to collect Social Security
    11  number information on the businesses that sell hunting and
    12  fishing licenses unduly complicates the license issuance
    13  transaction; and
    14     WHEREAS, Many purchasers of hunting and fishing licenses
    15  object to disclosure of their Social Security numbers to the
    16  private businesses that sell these licenses; and
    17     WHEREAS, The legitimate privacy concerns expressed by many
    18  purchasers of hunting and fishing licenses from private
    19  businesses need to be addressed; and
    20     WHEREAS, Collection of Social Security numbers from
    21  applicants for hunting and fishing licenses does not aid in
    22  effective enforcement of child support obligations but does
    23  unduly inconvenience both the sellers and purchasers of these
    24  licenses and raises legitimate concerns about protection of
    25  personal information; therefore be it
    26     RESOLVED, That the House of Representatives of the
    27  Commonwealth of Pennsylvania memorialize the President and
    28  Congress of the United States to eliminate the requirement that
    29  states must require applicants for hunting and fishing licenses
    30  to provide their Social Security numbers.
