| AN ACT |
| |
1 | Amending the act of August 15, 1961 (P.L.987, No.442), entitled |
2 | "An act relating to public works contracts; providing for |
3 | prevailing wages; imposing duties upon the Secretary of Labor |
4 | and Industry; providing remedies, penalties and repealing |
5 | existing laws," further providing for definitions; and |
6 | providing for school district options. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 2(4) of the act of August 15, 1961 (P.L. |
10 | 987, No.442), known as the Pennsylvania Prevailing Wage Act, is |
11 | amended to read: |
12 | Section 2. Definitions.--As used in this act-- |
13 | * * * |
14 | (4) "Public body" means [the] any of the following: |
15 | (i) The Commonwealth [of Pennsylvania, any of its]. |
16 | (ii) A political [subdivisions, any] subdivision. Except as |
17 | set forth in section 13.1, this subclause does not include a |
18 | school district or an authority, agency or instrumentality |

1 | established by one or more school districts. |
2 | (iii) An authority created by the General Assembly [of the |
3 | Commonwealth of Pennsylvania and any]. |
4 | (iv) An instrumentality or agency of the Commonwealth [of |
5 | Pennsylvania]. |

7 | Section 2. The act is amended by adding a section to read: |
8 | Section 13.1. School District Option.--Notwithstanding any |
9 | provision of this act, a school district or an authority, agency |
10 | or instrumentality established by one or more school districts |
11 | may elect, by resolution, to be a public body and to subject |
12 | itself to this act. |
13 | Section 3. All acts and parts of acts are repealed insofar |
14 | as they are inconsistent with this act. |
15 | Section 4. This act shall take effect in 60 days. |
