AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," requiring certain school 4 attendance as a condition for assistance. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The act of June 13, 1967 (P.L.31, No.21), known 8 as the Public Welfare Code, is amended by adding a section to 9 read: 10 Section 432.22. Required School Attendance.--(a) An 11 individual who is a recipient of aid to families with dependent 12 children or general assistance shall be required to attend 13 school as a requirement for continuing eligibility for such 14 assistance if all of the following apply: 15 (1) The individual is thirteen to nineteen years of age. 16 (2) The individual has not graduated from a public or 17 private high school or obtained a certificate of satisfactory 18 completion of a general educational development test.
1 (3) The individual is not legally excused from attending 2 school. 3 (4) The individual is not prohibited from attending school 4 while an expulsion is pending. 5 (5) If the individual was expelled from a school, there is 6 another school available which the individual can attend. 7 (6) The individual does not have good cause for failing to 8 attend school, as defined by the department by regulation. 9 (b) An individual who fails to meet the requirements of 10 subsection (a) shall be subject to such sanctions as the 11 department, by regulation, shall prescribe. 12 (c) The department may require consent to the release of 13 school attendance records as a condition of eligibility. 14 (d) If an individual required to attend school under 15 subsection (a) is enrolled in a public school, communications 16 between the school district and the department or a county 17 agency concerning the individual's school attendance may only be 18 made by a school attendance officer. 19 (e) The department shall request a waiver from the United 20 States Secretary of the Department of Health and Human Services 21 to permit the application of the school attendance requirements 22 under subsection (a). This section shall not be operative unless 23 the Federal waiver is in effect. 24 Section 2. This act shall take effect in 60 days. A30L67CHF/19890H0519B0581 - 2 -
