                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for truancy in
     6     school districts of the first class.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 1343.1.  Failure to Attend School in School Districts
    13  of the First Class.--In a school district of the first class, a
    14  police officer of the city shall have the authority to arrest,
    15  without warrant, a child who fails to attend school in
    16  compliance with the provisions of this act. If the school in
    17  which the child is enrolled is within the precinct to which the
    18  police officer arresting the child is assigned, the police
    19  officer shall promptly return the child to the school. If the


     1  school in which the child is enrolled is not within the precinct
     2  to which the police officer arresting the child is assigned, the
     3  police officer shall arrange for the child's temporary detention
     4  at a location designated by the police department and the school
     5  district consistent with the restrictions regarding detention
     6  set forth in 42 Pa.C.S. Ch. 63 (relating to juvenile matters). A
     7  police officer who arrests a child under this section shall
     8  promptly notify the child's parents or guardian of the actions
     9  taken regarding the child.
    10     Section 2.  This act shall take effect in 60 days.
