                                     AN ACT

     1  Amending the act of June 1, 1945 (P.L.1242, No.428), entitled
     2     "An act relating to roads, streets, highways and bridges;
     3     amending, revising, consolidating and changing the laws
     4     administered by the Secretary of Highways and by the
     5     Department of Highways relating thereto," providing
     6     authorization to utilize emergency contracting procedures for
     7     the construction or reconstruction of State highways and
     8     bridges.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The act of June 1, 1945 (P.L.1242, No.428), known
    12  as the State Highway Law, is amended by adding a section to
    13  read:
    14     Section 405.2.  Emergency Bidding Procedures.--In the event
    15  of a sudden disaster or emergency which poses a threat to public
    16  health or safety and which forces the unanticipated closing of a
    17  State highway or bridge, the department for a period of sixty
    18  (60) days may waive the advertising requirements set forth in
    19  section four hundred five of this act and obtain telephonic


     1  price quotations which are followed by a facsimile transmission
     2  confirming the quotation from at least three qualified and
     3  responsible contractors for all contracts directly related to
     4  the disaster or emergency. A written record of price quotations
     5  shall be made and shall contain at least the date of the
     6  quotation, the name of the contractor and the contractor's
     7  representative for the work which was the subject of the
     8  quotation and the price. Records of telephonic price quotations
     9  shall be retained for a period of three (3) years.
    10     Section 2.  This act shall take effect immediately.
