A RESOLUTION 1 Memorializing the Congress of the United States to adequately 2 fund implementation of the Help America Vote Act of 2002. 3 WHEREAS, Free and fair elections are crucial to the 4 establishment and perpetuation of democracy; and 5 WHEREAS, While working for democracy abroad, the United 6 States must preserve, protect and defend democracy at home; and 7 WHEREAS, Serious flaws in the Federal elections system were 8 exposed during the aftermath of the 2000 presidential election; 9 and 10 WHEREAS, In recognition of these flaws and in order to 11 protect any other Americans from disenfranchisement, the 12 Congress passed the Help America Vote Act of 2002 (HAVA); and 13 WHEREAS, The current level of Federal funding of HAVA 14 constitutes an underfunded Federal mandate; and 15 WHEREAS, According to the National Governors Association, the
1 financial health of state and local governments is at its lowest 2 point since World War II, thus greatly limiting states' 3 abilities to subsidize such an underfunded mandates; therefore 4 be it 5 RESOLVED, That the House of Representatives of the 6 Commonwealth of Pennsylvania memorialize the Congress to 7 adequately fund HAVA or release from compliance the states which 8 would not be able to financially support its requirements; and 9 be it further 10 RESOLVED, That copies of this resolution be transmitted to 11 the presiding officers of each house of Congress and to each 12 member of Congress from Pennsylvania.
