                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     regulations.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The definition of "child day care center" in
     8  section 1001 of the act of June 13, 1967 (P.L.31, No.21), known
     9  as the Public Welfare Code, amended December 21, 1988 (P.L.1883,
    10  No.185), is amended to read:
    11     Section 1001.  Definitions.--As used in this article--

    13     "Child day care center" means any premises operated for
    14  profit in which child day care is provided simultaneously for
    15  seven or more children [who are not relatives of the operator],
    16  except such centers operated under social service auspices.

     1     Section 2.  Sections 1070 and 1076 of the act, added December
     2  5, 1980 (P.L.1112, No.193), are amended to read:
     3     Section 1070.  Definitions.--As used in this article.--
     4     "Child day care" means care in lieu of parental care given
     5  for part of the twenty-four hour day to children away from their
     6  own homes.
     7     "Family day care home" means any home in which child day care
     8  is provided at any one time to [four] one through six children
     9  [who are not relatives of the caregiver].
    10     Section 1076.  Regulations.--The department is hereby
    11  authorized and empowered to adopt regulations establishing
    12  minimum and reasonable standards for the operation of family day
    13  care homes and the issuance of registration certificates. These
    14  regulations will establish the minimum standards of safety and
    15  care which will be required in family day care homes and will
    16  recognize the vital role which parents and guardians play in
    17  monitoring the care provided in family day care homes. The
    18  regulations shall provide that all day care providers be
    19  required to be registered and be checked for records of criminal
    20  activity or child abuse as part of the preregistration
    21  procedure.
    22     Section 3.  This act shall take effect in 60 days.
