AN ACT 1 Requiring all child day-care facilities in this Commonwealth to 2 have one or more persons competent in first aid techniques 3 and under certain circumstances cardiopulmonary resuscitation 4 (CPR) at the facility when one or more children are in care. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Short title. 8 This act shall be known and may be cited as the Child-Care 9 First Aid and CPR Act. 10 Section 2. Definitions. 11 The following words and phrases when used in this act shall 12 have the meanings given to them in this section unless the 13 context clearly indicates otherwise: 14 "Child day-care center." The premises in which care is 15 provided at any one time for seven or more children unrelated to 16 the operator. 17 "Department." The Department of Public Welfare of the 18 Commonwealth and its authorized agents. 19 "Facility." A child day-care center, family child day-care
1 home or group child day-care home. 2 "Family child day-care home." A home other than the child's 3 own home, operated for profit or not for profit, in which child 4 day care is provided at any one time to four, five or six 5 children unrelated to the operator. 6 "Group child day-care home." The premises in which care is 7 provided at one time for more than six but fewer than 16 older 8 school-age-level children or more than six but fewer than 13 9 children of another age level who are unrelated to the operator. 10 The term includes a facility located in a residence or another 11 premises. 12 Section 3. Staffing. 13 (a) Requirement.--Each child day-care center, group child 14 day-care home and family child day-care home, as regulated under 15 55 Pa. Code Chs. 3270 (relating to child day care centers), 3280 16 (relating to group child day care homes) and 3290 (relating to 17 family child day care homes), shall have: 18 (1) One or more persons who hold a current certificate 19 of completion of pediatric first aid training at the facility 20 when day-care children are in care. Such pediatric first aid 21 training shall include choke-saving and rescue breathing 22 techniques. 23 (2) At least one person at the facility who holds a 24 current certificate of completion of training in infant and 25 child cardiopulmonary resuscitation (CPR) when a child whose 26 child health physician identifies that the child has an 27 increased risk for needing heart resuscitation is in care at 28 the facility. The requirement under this paragraph shall be 29 in addition to the current requirement for infant and child 30 CPR as it relates to lifeguard training. 20010H0558B0601 - 2 -
1 (b) Training.-- 2 (1) Completion of training, including testing of skills 3 and knowledge, shall be documented by the signature and title 4 of a representative of the training entity and shall include 5 the date training was completed. Such training entity shall 6 be a State-licensed or state or nationally certified health 7 professional with pediatric training. Documentation shall be 8 retained in the facility in that person's file. 9 (2) The content of the first aid training shall include 10 the information specified in the current edition of Caring 11 for Our Children, the National Health and Safety Performance 12 Standards for Out-of-Home Child Care, published by the 13 American Academy of Pediatrics, the American Public Health 14 Association and the Maternal and Child Health Bureau of the 15 United States Department of Health and Human Services. The 16 content of the CPR training shall meet the current pediatric 17 guidelines for cardiopulmonary resuscitation and emergency 18 cardiovascular care of the American Heart Association's 19 Emergency Cardiovascular Care Committee. 20 (3) Pediatric first aid and CPR training shall be 21 renewed at least every three years. 22 Section 4. Applicability. 23 This act shall apply to each facility on the date of the next 24 licensing or certification renewal of that facility or one year, 25 whichever is longer. 26 Section 5.
