AN ACT 1 Amending the act of May 31, 1933 (P.L.1108, No.272), entitled, 2 "An act providing for the appointment, promotion, reduction, 3 removal and reinstatement of paid officers, firemen and 4 employes of fire departments and of fire alarm operators and 5 fire box inspectors in the bureaus of electricity in cities 6 of the third class; defining the powers and duties of civil 7 service commissions for such purposes; and fixing penalties," 8 providing for applicant residency qualifications. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 4 of the act of May 31, 1933 (P.L.1108, 12 No.272), entitled "An act providing for the appointment, 13 promotion, reduction, removal and reinstatement of paid 14 officers, firemen and employes of fire departments and of fire 15 alarm operators and fire box inspectors in the bureaus of 16 electricity in cities of the third class; defining the powers 17 and duties of civil service commissions for such purposes; and 18 fixing penalties," is amended to read: 19 Section 4. All examinations for positions or promotions 20 shall be practical in their character, and shall relate to such
1 matters, and include such inquiries, as will fairly and fully 2 test the comparative merit and fitness of the persons examined 3 to discharge the duties of the employment sought by them. All 4 examinations shall be open to all applicants who have fulfilled 5 the preliminary requirements required by this act. All 6 applicants for any position in the fire department and as fire 7 alarm operators and fire box inspectors in the bureau of 8 electricity shall, subject to regulations adopted by the civil 9 service commission, be required to submit to a physical 10 examination before being admitted to the regular examinations 11 held by the commission. Each applicant shall have been a 12 resident of the city in which he seeks employment for one year 13 next preceding date of his application. Adequate public notice 14 of the time and place of every examination held under the 15 provisions of this act, together with information as to the kind 16 of position or place to be filled, shall be given at least one 17 week prior to such examinations. The commission shall adopt 18 reasonable regulations for permitting the presence of 19 representatives of the press at the examinations. The commission 20 shall post, in a public place at its office, the eligible lists, 21 containing the names and grades of those who have passed 22 examinations, and shall indicate thereon such appointments as 23 may be made from said lists. 24 A city of the third class may exempt itself from the 25 residency requirements for applicants under this section and 26 promulgate its own standards for applicants. The city of the 27 third class shall consult with the Civil Service Commission in 28 promulgating these standards. 29 Section 2. This act shall take effect immediately. B5L11JRW/19970H0563B0626 - 2 -
