                                     AN ACT

     1  Amending Title 68 (Real and Personal Property) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     seller disclosure forms for residential real estate.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7304(b)(8) of Title 68 of the
     7  Pennsylvania Consolidated Statutes added December 20, 2000
     8  (P.L., No.114), is amended to read:
     9  § 7304.  Disclosure form.

    11     (b)  Contents of property disclosure statement.--The form of
    12  property disclosure statement promulgated by the State Real
    13  Estate Commission shall call for disclosures with respect to all
    14  of the following subjects:
    15         * * *


     1         (8)  Water and sewage systems or service. This paragraph
     2     includes all of the following:
     3             (i)  For drinking water, responses as to well
     4         failures, with specificity as to dates and frequencies;
     5         well restoration; and, in cases of a new well or
     6         alternative water source, capping of the old well.
     7             (ii)  With respect to sewage, for property on which
     8         there is no public sewer nor existing approved sewage
     9         treatment system, all of the following:
    10                 (A)  Responses as to soil testing and compliance
    11             with conventional sewage treatment methods.
    12                 (B)  Notice to the buyer about the prohibition,
    13             under the act of January 24, 1966 (1965 P.L.1535,
    14             No.537), known as the Pennsylvania Sewage Facilities
    15             Act, of construction or occupancy of a structure for
    16             which an individual or commercial sewage system is to
    17             be installed, altered or replaced without first
    18             obtaining a permit from a sewage enforcement officer.
    19                 (C)  Notice to the buyer that:
    20                     (I)  some soil and slope types cannot support
    21                 conventional sewage treatment methods;
    22                     (II)  additional testing and use of higher-
    23                 cost, alternative sewage treatment methods may be
    24                 required; and
    25                     (III)  the local sewage enforcement officer
    26                 should be contacted for more information.

    28     Section 2.  This act shall take effect in 90 days.
