                                     AN ACT

     1  Amending the act of October 4, 1978 (P.L.883, No.170), entitled,
     2     as reenacted, "An act relating to conflicts of interest
     3     involving certain public officials serving in State or State
     4     agencies and local political subdivision positions and
     5     prohibiting certain public employees from engaging in certain
     6     conflict of interest activities requiring certain disclosures
     7     and providing penalties," further providing for restricted
     8     activities and for penalties.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 3 of the act of October 4, 1978 (P.L.883,
    12  No.170), referred to as the Public Official and Employee Ethics
    13  Law, reenacted and amended June 26, 1989 (P.L.26, No.9), is
    14  amended by adding a subsection to read:
    15  Section 3.  Restricted activities.

    17     (c.1)  (1)  A solicitor may not offer or give to a public
    18     official, public employee or nominee or candidate for public
    19     office, anything of monetary value, including a gift, loan,
    20     political contribution, reward or promise of future
    21     employment if the person receiving the thing of monetary

     1     value:
     2             (i)  employs the solicitor or provides compensation
     3         to the solicitor for services rendered; or
     4             (ii)  is elected or appointed to the governmental
     5         body providing compensation to the solicitor for services
     6         rendered.
     7         (2)  A public official, public employee or nominee or
     8     candidate for public office may not solicit or accept
     9     anything of monetary value, including a gift, loan, political
    10     contribution, reward or promise of future employment from a
    11     solicitor who is in the employ of or receiving compensation
    12     for services rendered to:
    13             (i)  that public official, public employee or nominee
    14         or candidate for public office; or
    15             (ii)  the governmental body by which the public
    16         official or employee is employed or to which the public
    17         official or employee is appointed or selected.
    18         (3)  A person may not accept the position of solicitor
    19     with a governmental body if, within the past two years, the
    20     person offered or gave anything of monetary value, including
    21     a gift, loan, political contribution, reward or promise of
    22     future employment to a public official or public employee
    23     associated with that governmental body.

    25     Section 2.  Section 9(a) of the act is amended to read:
    26  Section 9.  Penalties.
    27     (a)  Any person who violates the provisions of section 3(a),
    28  [(b) and (c)] (b), (c) or (c.1) is guilty of a felony and shall
    29  be fined not more than $10,000 or imprisoned for not more than
    30  five years, or be both fined and imprisoned.
