        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           APRIL 14, 1997

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     limitation of certain Vehicle Code prosecutions.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5553(e) of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 5553.  Summary offenses involving vehicles.
     9     * * *
    10     (e)  Disposition of proceedings [within two years].--No
    11  proceedings shall be held or action taken [pursuant] by the
    12  minor judiciary as follows:
    13         (1)  Pursuant to a nonmoving summary offense under Title
    14     75, subsequent to two years after the commission of the
    15     offense.


     1         (2)  Pursuant to a moving summary offense under Title 75,
     2     subsequent to four years after the commission of the offense.
     3     This paragraph shall not apply to any of the following under   <--
     4     Title 75:
     5             (i)  Section 1501(a) (relating to drivers required to
     6         be licensed).
     7             (ii)  Section 1543 (relating to driving while
     8         operating privilege is suspended or revoked).
     9             (iii)  Section 3367 (relating to racing on highways).
    10             (iv)  Section 3733 (relating to fleeing or attempting
    11         to elude police officer).
    12             (v)  Section 3734 (relating to driving without lights
    13         to avoid identification or arrest).
    14             (vi)  Section 3748 (relating to false reports).
    15     Section 2.  The amendment of 42 Pa.C.S. § 5553(e) shall apply
    16  retroactively to actions pending on the effective date of this
    17  act.
    18     Section 3.  This act shall take effect immediately.
