                                     AN ACT

     1  Amending the act of June 2, 1915 (P.L.736, No.338), entitled "An
     2     act defining the liability of an employer to pay damages for
     3     injuries received by an employe in the course of employment;
     4     establishing an elective schedule of compensation; providing
     5     procedure for the determination of liability and compensation
     6     thereunder; and prescribing penalties," providing for an
     7     increase in compensation payments retroactive to the date of
     8     the date of the accident causing the compensable injury.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 306 of the act of June 2, 1915 (P.L.736,
    12  No.338), known as The Pennsylvania Workmen's Compensation Act,
    13  reenacted and amended June 21, 1939 (P.L.520, No.281), is
    14  amended by adding a subsection to read:
    15     Section 306.  The following schedule of compensation is
    16  hereby established:
    17     * * *
    18     (i)  Any person receiving compensation under section 306(a),
    19  (b), (c)(23) or Section 307 on or after January 1, 1990, shall
    20  be entitled to a four per centum increase in the compensation


     1  payment retroactive to the date of the compensable injury. The
     2  additional compensation shall be paid by the self-insured
     3  employer or insurance carrier making payment and shall be
     4  reimbursed in advance by the Commonwealth on a quarterly basis
     5  as provided in rules and regulations of the department. The
     6  payment of additional compensation shall be made by the carrier
     7  or self-insured employer only during those fiscal years for
     8  which appropriation are made to cover reimbursement.
     9     Section 2.  This act shall be applicable to all compensation
    10  payments made on or after January 1, 1990.
    11     Section 3.  This act shall take effect immediately.
