AN ACT
1 Amending the act of December 19, 1984 (P.L.1093, No.219),
2 entitled "An act relating to noncoal surface mining
3 conservation and reclamation," exempting from licensing and
4 permitting certain noncoal surface mining entities.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Sections 5 and 7 of the act of December 19, 1984
8 (P.L.1093, No.219), known as the Noncoal Surface Mining
9 Conservation and Reclamation Act, are amended by adding
10 subsections to read:
11 Section 5. Operator's license.

13 (g) Exemption.--This section shall not apply to a person who
14 mines 1,000 tons or less of a marketable mineral per year.
15 Section 7. Mining permit; reclamation plan.

17 (d) Exemption.--This section shall not apply to a person who
18 mines 1,000 tons or less of a marketable mineral per year.
1 Section 2. This act shall take effect in 60 days.
