                                     AN ACT

     1  Amending Title 71 (State Government) of the Pennsylvania
     2     Consolidated Statutes, authorizing creditable service for
     3     certain persons who were justices of the peace.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5505 of Title 71 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 5505.  Contributions for the purchase of credit for creditable
     9             nonstate service.

    11     (g)  Justice of the peace service.--Contributions on account
    12  of credit for service as a justice of the peace shall be
    13  determined by the board to be equal to the amount he would have
    14  paid as employee contributions together with statutory interest
    15  to date of purchase had he been a State employee during his
    16  period of service as a justice of the peace for the


     1  Commonwealth. The amount so determined by the State Employees'
     2  Retirement Board to be paid into the State Employees' Retirement
     3  System shall be the obligation of the justice who requested
     4  credit for previous service as a justice of the peace for the
     5  Commonwealth prior to 1970. A justice of the peace desiring to
     6  purchase his service time prior to 1970 shall have been elected
     7  or appointed a district justice any time during or after 1970.
     8  The class that he is to enter in the pension system shall be
     9  determined by the time of his entry into the district justice
    10  system. It shall be incumbent upon the district justice to
    11  certify to the board with a copy of his commission or
    12  commissions the amount of time that he served the Commonwealth
    13  as a justice of the peace. The salary dollar amount that shall
    14  be used in the formula to determine the amount of pension the
    15  district justice may purchase shall be equal to the starting
    16  salary of the district justice for the magisterial district in
    17  which he was elected, dating from the beginning of the district
    18  justice system as of January 1970. In no event shall such an
    19  amount be the obligation of the Commonwealth or the county in
    20  which the justice served.
    21     Section 2.  This act shall take effect immediately.
