AN ACT

 

1Amending Title 34 (Game) of the Pennsylvania Consolidated
2Statutes, further providing for unlawful devices and methods.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 2308(b) of Title 34 of the Pennsylvania
6Consolidated Statutes is amended to read:

7§ 2308. Unlawful devices and methods.

9(b) Exceptions.--The provisions of subsection (a) shall not
10apply to:

11(1) (i) Any archery sight or firearm's scope which
12contains and uses any mechanical, photoelectric,
13ultraviolet or solar-powered device to solely illuminate
14the sight or crosshairs within the scope.

15(ii) Except as otherwise provided under subparagraph
16(iii), no archery sight or firearm's scope shall contain
17or use any device, no matter how powered, to project or

1transmit any light beam, infrared beam, ultraviolet light
2beam, radio beam, thermal beam, ultrasonic beam, particle
3beam or other beam outside the sight or scope onto the
4target.

5(iii) (A) A flashlight or spotlight may be mounted
6on a firearm to take furbearers if the sole source of
7power for the flashlight or spotlight is contained
8within the flashlight or spotlight or on the person.

9(B) For the purposes of this subparagraph, a
10flashlight or spotlight mounted on a firearm shall
11not include a device that projects a beam of laser
12light to indicate the intended point of impact for
13one or more projectiles discharged from the firearm.

14(2) (i) Any political subdivision, its employees or
15agents, which has a valid deer control permit issued
16under section 2902(c) (relating to general categories of
17permits).

18(ii) Any licensed hunter in cities of the first
19class, while hunting on private property and using a bow
20and arrow or crossbow, using bait to attract deer for
21removal as provided by commission regulations.

22(iii) Any licensed hunter in special regulation
23areas, other than counties of the second class, using
24bait to attract deer for removal as provided by
25commission regulations.

26(3) Any artificial or manufactured turkey blind
27consisting of all manmade materials of sufficient density to
28block the detection of movement within the blind from an
29observer located outside of the blind.

30(4) Any natural or manmade nonliving bait used to

1attract coyotes for hunting or trapping.

2(5) Any electronic or mechanical device used to attract
3coyotes for hunting or trapping.

4(6) Any decoy used in the trapping or hunting of
5furbearers.

6(7) Any shelled or eared corn used as an enticement for
7wildlife or bait for game.

9Section 2. This act shall take effect immediately.
