                                     AN ACT

     1  Amending Title 71 (State Government) of the Pennsylvania
     2     Consolidated Statutes, providing for the purchase of credit
     3     for either nonintervening or intervening military service by
     4     surviving spouses.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 71 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 5505.2.  Surviving spouse purchase of certain military service
    10             time.
    11     If, prior to death, an active officer of the Pennsylvania
    12  State Police fails to purchase either nonintervening military
    13  service under section 5505(b) (relating to contributions for the
    14  purchase of credit for creditable nonstate service) or
    15  intervening military service under section 5505(c), then the
    16  surviving spouse shall have the right and may within 90 days of
    17  the death of the officer member or within 90 days after the
    18  effective date of this section exercise the right to purchase
    19  such service in accordance with the terms specified in section

     1  5505(b) or (c).
     2     Section 2.  This act shall be retroactive to July 1, 1991.
     3     Section 3.  This act shall take effect immediately.
