AN ACT 1 Amending the act of July 28, 1988 (P.L.556, No.101), entitled 2 "An act providing for planning for the processing and 3 disposal of municipal waste; requiring counties to submit 4 plans for municipal waste management systems within their 5 boundaries; authorizing grants to counties and municipalities 6 for planning, resource recovery and recycling; imposing and 7 collecting fees; establishing certain rights for host 8 municipalities; requiring municipalities to implement 9 recycling programs; requiring Commonwealth agencies to 10 procure recycled materials; imposing duties; granting powers 11 to counties and municipalities; authorizing the Environmental 12 Quality Board to adopt regulations; authorizing the 13 Department of Environmental Resources to implement this act; 14 providing remedies; prescribing penalties; establishing a 15 fund; and making repeals," further providing for performance 16 grants for municipal recycling programs. 17 The General Assembly of the Commonwealth of Pennsylvania 18 hereby enacts as follows: 19 Section 1. Section 904(b) of the act of July 28, 1988 20 (P.L.556, No.101), known as the Municipal Waste Planning, 21 Recycling and Waste Reduction Act, is amended to read:
1 Section 904. Performance grants for municipal recycling 2 programs. 3 * * * 4 (b) Availability.--[The department shall award a grant under 5 this section to a municipality based on the type and weight of 6 source-separated recyclable materials identified in section 1501 7 that were recycled in the previous calendar year, and the 8 population of the municipality.] The department shall award a 9 grant under this section to a municipality based on factors such 10 as: 11 (1) Type and weight of municipal waste recycled 12 annually. 13 (2) Type and volume of municipal waste recycled 14 annually. 15 (3) Unit cost to collect, store, transport and prepare 16 to sell to recycler. 17 (4) Grants or other subsidy income from selling material 18 to recycler. 19 (5) Total cost of operation which shall include the 20 costs incurred by the municipality for employees engaged in 21 the operation. 22 (6) Effectiveness of program. 23 * * * 24 Section 2.
