AN ACT 1 Amending the act of July 13, 1987 (P.L.346, No.66), entitled "An 2 act providing that certain funds received under the Federal 3 Job Training Partnership Act shall be used to provide support 4 services related to job training; and providing for 5 eligibility for such services," further providing for 6 eligibility and for programs. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Sections 5 and 6 of the act of July 13, 1987 10 (P.L.346, No.66), known as the Dislocated Worker Training 11 Assistance Act, are amended to read: 12 Section 5. Eligibility for needs-based payments. 13 (a) Eligible individuals.--Individuals eligible for needs- 14 based payments under this act are dislocated workers who meet 15 all of the following requirements: 16 (1) They are enrolled in a Title III program. 17 (2) They are not earning a wage.
1 (3) Their unemployment compensation payments have been 2 exhausted under any State or Federal program, including 3 specific eligibility under the Trade Act of 1974 (Public Law 4 93-618, 19 U.S.C. § 2101 et seq.), as amended. 5 Individuals who are otherwise eligible for employment or 6 training services may not be denied such services by reason of 7 being eligible for needs-based payments which could be provided 8 under this act. 9 (b) Level of payment.--Needs-based payments shall be 10 authorized so each recipient of a Title III grant would be 11 permitted to establish a level of payment tailored to the 12 individual need of each dislocated worker. The maximum payment 13 shall not exceed the maximum cash assistance payment for that 14 county: Provided, however, That participants with no other 15 income shall be eligible to receive up to the maximum payment 16 level. Participants with other sources of income shall be 17 eligible to receive a needs-based payment consistent with the 18 level authorized for participants in the Title II program 19 operated in the area. 20 (c) Extent of payment.--Payments shall be made up to the 21 extent to which funds are appropriated for the program, but in 22 no case will payments be permitted for a period of training 23 which exceeds two years. At least 10% of the payments shall be 24 made to dislocated workers who are salaried employees. 25 (d) Suspension of payment.--Each recipient of a Title III 26 grant must assure that payments are disallowed for days of 27 training which the participant fails to attend. 28 Section 6. Dislocated worker programs. 29 Funds not allocated for use for needs-based payments or bonus 30 payments shall be used for general employment and training 19970H0735B0827 - 2 -
