AN ACT 1 Amending the act of November 26, 1978 (P.L.1415, No.333), 2 entitled "An act designating a portion of the Schuylkill 3 River as a component of the Pennsylvania Scenic Rivers System 4 in accordance with the Pennsylvania Scenic Rivers Act; 5 authorizing further classification; providing for 6 cooperation, limitation of liability and protection of 7 critical areas, and authorizing the expenditure of moneys," 8 relating to designation and classification. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 4 of the act of November 26, 1978 12 (P.L.1415, No.333), known as the Schuylkill Scenic River Act, 13 amended March 2, 1988 (P.L.100, No.17), is amended to read: 14 Section 4. Designation and classification. 15 (a) The portion of the Schuylkill River, including related 16 adjacent land areas, from the Forks at Port Clinton, Schuylkill 17 County, to Fairmont Dam, Philadelphia County, [excepting the 5.2 18 mile segment between Norristown Dam and Spring Mill Creek,] is 19 designated as a component of the Pennsylvania Scenic Rivers 20 System under the Pennsylvania Scenic Rivers Act. The Schuylkill
1 River designation is extended to include a portion of the 2 Schuylkill River and related adjacent land areas in Schuylkill 3 and Berks Counties and portions of the West Branch and Little 4 Schuylkill River tributaries and their related adjacent land 5 areas in Schuylkill County. The boundaries of the component and 6 of the classified segments have been defined by the Department 7 of Environmental Resources and are shown on the maps entitled 8 "SCHUYLKILL RIVER STUDY" and "SCHUYLKILL RIVER EXTENSION STUDY" 9 which are on file and available for public inspection in the 10 Division of Land Records, Pennsylvania Historical and Museum 11 Commission of the Commonwealth of Pennsylvania. 12 (b) Segments of the component are classified as follows: 13 (1) Port Clinton (Forks) to Cross Keys (Bridge)--16.2 14 river miles--recreational. 15 (2) Cross Keys (Bridge) to Reading (Route 422 above 16 Fritz Island)--12.3 miles--modified recreational. 17 (3) Reading (Route 422 Bridge over Fritz Island) to 18 Douglassville (Bridge)--15.3 river miles--recreational. 19 (4) Douglassville (Bridge) to [Norristown Dam--34.2] 20 Fairmont Dam--49.8 river miles--modified recreational. 21 [(5) Spring Mill Creek to Fairmont Dam--10.4 river 22 miles--modified recreational.] 23 (6) Route 209 (Highway) to Cressona Route 183 (Bridge)-- 24 5.0 river miles--recreational. 25 (7) Cressona Route 183 (Bridge) to Auburn Basin 26 (Spillway)--9.6 river miles--modified recreational. 27 (8) Auburn Basin (Spillway) to Port Clinton (Forks)--7.4 28 river miles--recreational. 29 (9) Port Clinton (Forks) to [T848 (Bridge)--9.1] New 30 Ringgold Route 895 (Bridge)--10.9 river miles--pastoral. 19910H0782B0859 - 2 -
1 [(c) The Secretary of Environmental Resources is authorized 2 to classify the 5.2 mile segment between Norristown Dam and 3 Spring Mill Creek as "modified recreational" when he determines 4 that it meets the criteria for such classification. When so 5 classified, that segment shall become art of the Schuylkill 6 scenic river component designated under this act, and all of the 7 provisions of this act and of the "Pennsylvania Scenic Rivers 8 Act" shall become applicable thereto.] 9 Section 2.
