AN ACT 1 Amending the act of July 10, 1990 (P.L.404, No.98), entitled "An 2 act providing for the certification of real estate 3 appraisers; specifying requirements for certification; 4 providing for sanctions and penalties; and making an 5 appropriation," further providing for the State Board of 6 Certified Real Estate Appraisers; and providing for 7 violations of act and for remedies available to consumers. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 4(a) of the act of July 10, 1990 11 (P.L.404, No.98), known as the Real Estate Appraisers 12 Certification Act, is amended to read: 13 Section 4. State Board of Certified Real Estate Appraisers. 14 (a) Creation.--There is hereby created the State Board of 15 Certified Real Estate Appraisers as a departmental 16 administrative board in the Department of State. The board shall 17 consist of [seven members] the following members: 18 (1) The Secretary of the Commonwealth or a designee. 19 (2) The Attorney General or a designee. 20 (3) Seven members who are citizens of the United States
1 and who have been residents of this Commonwealth for a two- 2 year period immediately prior to appointment, [two] three of 3 whom shall be public members[,] and four of whom shall be 4 persons who are State-certified real estate appraisers [and 5 one of whom shall be the Secretary of the Commonwealth or his 6 or her designee.] 7 For the initial board appointments, the four professional 8 members need not be certified at the time of appointment but 9 shall have appropriate appraisal experience and education and 10 shall have demonstrated adherence to standards of professional 11 practice. 12 * * * 13 Section 2. The act is amended by adding sections to read: 14 Section 15.1. Violations. 15 A violation of this act is also a violations of the act of 16 December 17, 1968 (P.L.1224, No.387), known as the Unfair Trade 17 Practices and Consumer Protection Law. 18 Section 17.1. Remedies available to consumers. 19 Nothing in this act shall be construed to limit the remedies 20 available to consumers, the Attorney General or any district 21 attorney under the act of December 17, 1968 (P.L.1224, No.387), 22 known as the Unfair Trade Practices and Consumer Protection Law, 23 or any other Federal or State law. 24 Section 3.
