                                     AN ACT

     1  Amending the act of April 27, 1927 (P.L.465, No.299), entitled,
     2     as amended, "An act to provide for the safety of persons
     3     employed, housed, or assembled in certain buildings and
     4     structures by requiring certain construction and ways of
     5     egress, equipment, and maintenance; providing for the
     6     licensing of projectionists, except in cities of the first
     7     class and second class; requiring the submission of plans for
     8     examination and approval; providing for the promulgation of
     9     rules and regulations for the enforcement of this act;
    10     providing for the enforcement of this act by the Department
    11     of Labor and Industry, the Department of Health, boards of
    12     school directors and, in certain cases, by the chiefs of fire
    13     departments in cities of the third class; providing penalties
    14     for violations of the provisions of this act; and repealing
    15     certain acts," requiring the Department of Labor and Industry
    16     to inspect school buildings for fire safety.

    17     The General Assembly of the Commonwealth of Pennsylvania
    18  hereby enacts as follows:
    19     Section 1.  Section 1 of the act of April 27, 1927 (P.L.465,
    20  No.299), referred to as the Fire and Panic Act, amended May 28,
    21  1937 (P.L.1016, No.281), is amended to read:


     1     Section 1.  Be it enacted, &c., That,
     2     General Requirement.--Every building enumerated in this act,
     3  erected or adapted for any of the purposes of the several
     4  classes of buildings covered by this act, shall be so
     5  constructed, equipped, operated, and maintained, with respect to
     6  type of construction and materials used, fireproofing, number
     7  and type of ways of egress, aisles and passageways, stairs and
     8  fire escapes, wall openings, exits and exit signs, doors and
     9  doorways, shaftways and other vertical openings, emergency
    10  lighting, automatic sprinkler systems, fire alarm systems, fire
    11  drills, electrical equipment, inflammable and explosive
    12  materials, heating apparatus and fuel storage, number of
    13  occupants, ventilation, arrangement of seating and standing
    14  space, construction and equipment of stages, projection rooms,
    15  and dressing rooms, and all other fire and panic protection as
    16  to provide for the safety and health of all persons employed,
    17  accommodated, housed, or assembled therein. Whenever any
    18  building designated in this act shall, in the opinion of the
    19  Department of Labor and Industry, become dangerous to further
    20  occupancy because of structural or other defects, it shall
    21  immediately be closed to further occupancy, and a sign posted
    22  thereon to that effect. Such building shall not again be
    23  occupied until all recommendations of the department to
    24  eliminate hazardous conditions are complied with.
    25     The Department of Labor and Industry shall have the power,
    26  and its duty shall be, to make, alter, amend, or repeal rules
    27  and regulations for carrying into effect all of the provisions
    28  of this act, applying such provisions to specific conditions,
    29  and prescribing means, methods and practices to make effective
    30  such provisions. The Department of Labor and Industry shall

     1  inspect annually all school buildings within the Commonwealth
     2  for fire safety.
     3     Section 2.  This act shall take effect in 30 days.
