        INTRODUCED BY D. R. WRIGHT, J. L. WRIGHT, COHEN, ROBINSON,
           LETTERMAN, BISHOP, KOSINSKI, FOX, STEIGHNER, ITKIN, CAWLEY,
           RYBAK, VAN HORNE, COY, JOHNSON, DeLUCA, VEON AND LAUGHLIN,
           MARCH 14, 1989

                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," adding rights, duties and
    21     jurisdiction to security and campus police under certain
    22     conditions.

    23     The General Assembly of the Commonwealth of Pennsylvania
    24  hereby enacts as follows:
    25     Section 1.  The introductory and last paragraphs of section
    26  2416 of the act of April 9, 1929 (P.L.177, No.175), known as The
    27  Administrative Code of 1929, amended September 27, 1978

     1  (P.L.775, No.149), are amended and the section is amended by
     2  adding a clause to read:
     3     Section 2416.  Capitol Police, Commonwealth Property Police
     4  and Campus Police.--The Capitol Police, Commonwealth Property
     5  Police and the Security or Campus Police of all State [colleges
     6  and] owned universities, State aided or related colleges and
     7  universities and community colleges shall have the power, and
     8  their duty shall be:
     9     * * *
    10     (i)  To enter into an agreement with the municipal police
    11  force where the State owned university, State aided or related
    12  college or university, or community college is located, defining
    13  the geographical boundaries of the area adjacent to the
    14  institution, and Security or Campus Police shall have the same
    15  power and authority granted to municipal police including the
    16  right to pursuit and arrest when acting in the area defined in
    17  the agreement.
    18     Security [and] or Campus Police shall exercise their powers
    19  and perform their duties only on the premises of the State
    20  [colleges and] owned universities, State aided or related
    21  colleges and universities and community colleges by or for which
    22  they are employed and also the area adjacent thereto, where
    23  there has been an agreement authorized by clause (i), and only
    24  after they have completed a course of training including crisis
    25  intervention training and riot control as approved by the
    26  Department of Education and, if they carry a firearm, training
    27  in accordance with the act of June 18, 1974 (P.L.359, No.120),
    28  referred to as the "Municipal Police Education and Training
    29  Law," except, that Security or Campus Police employed by State
    30  owned [colleges and] universities, State aided or related

     1  colleges and universities and community colleges located in any
     2  [municipalities, other than cities of the first class or second
     3  class, are authorized,] municipality upon request of the mayor
     4  or other executive authority in emergency situations occurring
     5  within the municipality, [upon the request of the mayor or other
     6  executive authority] and under the direction of the local law
     7  enforcement authorities, [to] may exercise those powers and
     8  perform those duties conferred pursuant to this section within
     9  the municipality for the limited purpose of aiding local
    10  authorities in emergency situations and except that Security or
    11  Campus Police employed by State owned universities, State aided
    12  or related colleges and universities or community colleges shall
    13  have the same powers of arrest granted to police officers of
    14  political subdivisions by 42 Pa.C.S. Chapter 89 Subch. D
    15  (relating to municipal police jurisdiction). When so acting, the
    16  Campus Police shall be acting within the scope of the authority
    17  of this act and are, at all times, [State] employes of this
    18  Commonwealth, State aided or related colleges and universities
    19  or community colleges respectively and entitled to all the
    20  rights and benefits accruing therefrom.
    21     Section 2.  This act shall take effect immediately.
